These terms govern your use of Obsidiate — the platform, the website, the API and the card. They are written to be read; if anything is unclear, ask us before you agree to it.
1. Who we are and what you're agreeing to
Obsidiate operates a multi-asset trading platform offering spot trading in cryptocurrencies, equities, foreign exchange and precious metals, together with related services such as staking, the Obsidiate Card and an OTC desk. By creating an account or using any part of the service you agree to these terms, our Privacy Policy and our AML / KYC Policy.
If you do not agree, do not use the platform — that is the only fair reading of a terms page.
2. Eligibility
You must be at least 18 years old, legally capable of entering binding contracts, and not resident in a jurisdiction where our services would be unlawful. We verify identity at registration and may decline, limit or close accounts where verification cannot be completed.
One person, one account. Duplicate accounts may be merged or closed.
3. Your account and its security
You are responsible for your credentials. We provide the tools — strong password requirements, two-factor authentication, withdrawal address whitelists, device trust controls — and we strongly recommend you use all of them.
We will never ask for your password, 2FA codes or recovery phrases. Anyone who does is not us.
4. The services
Market data, order execution, custody, staking, card payments and the API are provided as described on the relevant pages of this site, including the fee schedule, which forms part of these terms. Fees are shown before you pay them; changes apply prospectively, never retroactively to executed trades or running locks.
Staking terms — including lock periods that cannot be exited early — are stated on the staking page and confirmed before each stake.
5. Trading risks
Trading involves risk. The value of your portfolio can go down as well as up, and you may get back less than you put in. Cryptocurrencies in particular are volatile, and past performance is not a guide to future results. Nothing on this platform is investment advice; we provide execution and information, not recommendations.
You are responsible for your own decisions and for any taxes they create.
6. Prohibited use
You may not use Obsidiate for money laundering, terrorist financing, sanctions evasion, fraud, market manipulation (including spoofing and wash trading), unauthorized access attempts, or any activity that is illegal where you live or where we operate. We monitor for these patterns and we act on them.
Breach of this section can result in immediate suspension, account closure and reporting to authorities where the law requires it.
7. AML / KYC
We are obliged to know our customers. That means identity verification at signup, transaction monitoring, source-of-funds enquiries where size or pattern warrants it, and cooperation with lawful requests from authorities. Limits scale with verification level.
8. Custody and proof of reserves
Customer assets are held segregated from company funds, predominantly in cold storage. Reserve wallets are published and customer liabilities are independently attested monthly — see the proof-of-reserves page. Customer assets are never lent, pledged or rehypothecated.
9. Availability and changes
We aim for boring reliability and publish our uptime on the status page, but no platform can promise uninterrupted service. We may modify or discontinue features with reasonable notice where practicable. Material changes to these terms will be announced at least 14 days before they take effect.
10. Liability
To the extent permitted by law, we are not liable for losses caused by market movements, third-party failures (including blockchain networks and banking rails), or events outside our reasonable control. Nothing in these terms excludes liability that cannot lawfully be excluded — including for fraud or willful misconduct.
11. Termination
You can close your account at any time after settling open positions and withdrawing your balances. We can suspend or terminate accounts for breach of these terms, legal necessity, or risk reasons — with notice except where the law or the risk itself prevents it.
